Terms of Service

Customer Acknowledgement

By placing an order with CopyCa Inc., the customer confirms that they have carefully reviewed and approved all spelling, content, and layout within the document. The customer understands that the document will be printed exactly as it appears in the final proof and that post-submission alterations may not be possible. The customer accepts full responsibility for any typographical or content errors.

IMPORTANT NOTICE

Please read these Terms and Conditions carefully. By accessing or using this website, you confirm that you agree to be bound by the terms outlined below. If you do not accept these terms, please refrain from using this site. CopyCa Inc. reserves the right to modify or amend these Terms and Conditions at its discretion and without prior notice. Continued use of the website constitutes acceptance of any changes.

1. Order Approval

The customer is solely responsible for thoroughly reviewing and approving the final proof and layout of their order before printing. CopyCa Inc. accepts no liability for errors in the final product resulting from the following, including but not limited to: language, spelling, grammar, typography, graphic elements, bleed areas, damaged fonts, overprinted content, form field errors, files not built to template specifications, or incorrect page order. By submitting an order, the customer acknowledges that they assume full responsibility for all errors not corrected during the proofing stage.

2. Copyright and Intellectual Property

All content on this site, including text, images, software, and graphics, is the property of CopyCa Inc. or its licensors and is protected by copyright and other intellectual property laws. Unauthorized use, redistribution, copying, or republication of this material, including trademarks, logos, and proprietary content, is strictly prohibited. The customer affirms they have the legal rights to all materials submitted to CopyCa Inc. and will not use any unlicensed intellectual property. CopyCa Inc. reserves the right to refuse service if the customer’s content violates copyright or intellectual property laws. The customer agrees to indemnify CopyCa Inc. for any claims related to unauthorized use of intellectual property.

3. Customer Content

The customer is solely responsible for all materials submitted, including data, images, and graphics (collectively, "Content"). CopyCa Inc. disclaims any responsibility for content that may be offensive, defamatory, unlawful, or otherwise objectionable. The customer agrees not to submit content that includes (i) explicit or obscene material, (ii) threats, blackmail, or harassment, (iii) defamatory or harmful statements, or (iv) material that infringes upon intellectual property or proprietary rights. CopyCa Inc. reserves the right, though not the obligation, to remove content that violates these terms and may disclose content as required by law. The customer agrees to use CopyCa Inc. services for lawful purposes only and to maintain the confidentiality of their account information.

4. Governing Law and Legal Jurisdiction

This Agreement shall be governed by and construed under the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall be exclusively adjudicated in the courts located in Ontario. The customer consents to the jurisdiction and venue of these courts and waives any objection to these terms.

5. Limitation of Liability

To the maximum extent permitted by law, CopyCa Inc. shall not be liable for any special, incidental, indirect, or consequential damages arising from the use of this website, including loss of data, profit, or business interruption. CopyCa Inc. is also not liable for damages related to delays, errors, or omissions caused by factors beyond its reasonable control, such as external technical issues, third-party service disruptions, or force majeure events.

6. Indemnity

The customer agrees to indemnify, defend, and hold harmless CopyCa Inc., its affiliates, directors, officers, and employees from any and all claims, damages, costs, expenses, or liabilities, including attorney’s fees, resulting from any breach of these Terms and Conditions, or claims arising from materials submitted by the customer. This indemnification obligation includes any actions, suits, or proceedings brought against CopyCa Inc. by third parties.

7. Customer Submitted Artwork

All artwork or design files must be submitted in CMYK color format at a resolution of no less than 300 DPI. CopyCa Inc. disclaims any responsibility for poor image quality resulting from artwork that is out of specification. The customer acknowledges that color variations may occur during the conversion process from RGB to CMYK.

8. Color Proofing and Matching

CopyCa Inc. will make every reasonable effort to achieve color matching as specified in the proof; however, the customer accepts that color variations may occur and are not grounds for reprints or refunds. The customer acknowledges that factors such as paper stock, coatings, and equipment variability can impact color consistency, and minor deviations in color are to be expected and are deemed acceptable.

9. Trimming and Folding Tolerances

CopyCa Inc. allows a standard tolerance of up to 0.125 inches on trimming and folding. The customer must design their artwork within this tolerance, and CopyCa Inc. will not be held liable for any slight misalignments due to trimming or folding variances.

10. Order Cancellation

Orders may be canceled upon request prior to the commencement of the production process. Any cancellation will be subject to applicable cancellation fees (5-10% or min 10$) to cover administrative costs. After production has started, it cannot be cancelled or refunded. Because your files are tailored to your specific needs, they cannot be reused by anyone else. We kindly ask you to review your order carefully and make sure everything is correct before finalizing your purchase.

11. Returns and Refunds

All sales are final due to the custom nature of each order. In the event of an error by CopyCa Inc., the company reserves the right to reprint or issue a partial credit or refund at its sole discretion. The customer must notify CopyCa Inc. of any defects within 10 business days of receipt; otherwise, the product is deemed accepted.

12. Shipping and Delivery

Delivery timelines are estimated and are not guaranteed. CopyCa Inc. disclaims liability for any delays caused by factors outside of its control, including shipping carrier issues, customs processing, and external technical failures. In the event of technical issues within CopyCa Inc., the customer may be eligible for a refund or waiver of rush fees, but such technical difficulties do not constitute grounds for cancellation or refunds.

13. Incorrect Address

If a shipment is returned due to incorrect address details provided by the customer, the customer will be responsible for additional shipping fees to reship the package to the correct address.

14. Third-Party Links

CopyCa Inc. may provide links to third-party websites for customer convenience. CopyCa Inc. does not endorse these sites, nor is it responsible for their content or operations. Access to these sites is at the customer's own risk.

15. Overruns and Underruns

A variance in the final quantity delivered (up to 5% over or under the ordered quantity) is deemed acceptable, and CopyCa Inc. is not obligated to provide additional prints to compensate for this variance.

16. Indemnification for Intellectual Property

The customer guarantees they have ownership rights for all materials submitted for printing. The customer agrees to indemnify CopyCa Inc. for any claims related to copyright infringement, libel, or privacy violations associated with the printed materials.

17. Payment Information Security

Payment information is securely processed by authorized third-party providers. CopyCa Inc. does not store credit card information on its servers and disclaims any liability associated with payment processing handled by these providers.

18. Non-Solicitation

The customer and affiliates shall not directly or indirectly solicit any employee, contractor, or consultant of CopyCa Inc. for a period of two (2) years following the last submitted order without prior written consent from CopyCa Inc.

19. Print on Demand Services

Separate terms apply to Print on Demand services; please refer to those specific Terms of Service for details.

20. Food Labeling Compliance

CopyCa Inc. disclaims responsibility for ensuring compliance with food labeling regulations. The customer is solely responsible for verifying that all content on labels complies with relevant regulations in the intended distribution markets.
